The Eastern Cape Grand Tour

INDEMNITY, RELEASE AND ACKNOWLEDGEMENT OF RISK The Eastern Cape Grand Tour, organised by Xtreme Octane ("the Organisers"). 1. Nature of the event The Grand Tour is a non-competitive touring road rally held on public roads. It is not a race. No section is timed, no result is awarded for speed, and ordinary South African road traffic law applies for its entire duration. Any conduct that treats it as a race is a breach of these terms. 2. Authority to accept I am the lead driver of this entry. I accept this indemnity for myself and, being duly authorised to do so, on behalf of every occupant of my vehicle. Where an occupant is under 18, I confirm that I am their parent or legal guardian or that I have that person's authority to accept on their behalf. I undertake to bring the contents of this indemnity to the attention of every occupant before the event. 3. Licensing and lawful conduct Every person who drives any part of this event holds a valid, unsuspended driver's licence and will carry it throughout. All drivers will obey the National Road Traffic Act and all applicable traffic law at all times, including speed limits, road signage and the rules of the road. No person will drive under the influence of alcohol or any drug that impairs driving. 4. The vehicle My vehicle is roadworthy and licensed, and remains my responsibility for the whole event. I accept that the Organisers do not inspect, approve or warrant the condition of any vehicle, that no scrutineering by them takes place, and that the Organisers provide no insurance of any kind in respect of my vehicle. 5. Acknowledgement of risk I understand that driving over long distances on public roads carries real risk, including collision with other traffic, road and weather conditions, loose surfaces, animals on the road, mechanical failure, driver fatigue and the acts of other participants and road users. Parts of the route are remote, and emergency or medical assistance may take significant time to reach me. I participate voluntarily, with full knowledge of these risks, and I accept them. 6. Responsibility for my own driving I remain solely responsible for how my vehicle is driven, for the decisions I make on the road, and for the consequences of both. No clue, instruction, route note or communication from the Organisers relieves me of that responsibility or of any legal obligation, and nothing issued during the event should be read as requiring me to drive in a way that is unsafe or unlawful. 7. Own arrangements I am responsible for my own medical cover, travel and personal insurance. I consent to the Organisers arranging emergency medical treatment on my behalf if I am unable to consent at the time, and I accept that the cost of any such treatment is mine. 8. Personal property My vehicle and belongings are at my own risk throughout, including at accommodation, at stops and while parked. 9. Release and indemnity To the fullest extent permitted by law, I release the Organisers, their directors, employees, officials, marshals and volunteers, and the event's sponsors, partners, venues and landowners, from all liability for any injury, death, loss or damage suffered by me or by any occupant of my vehicle arising out of participation in this event. I indemnify them against any claim brought by me or on my behalf in respect of the same. This release does not exclude liability for gross negligence or for any liability that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 or any other law. 10. Third parties I remain liable for any loss or damage that I or my occupants cause to any other person or to property during the event. 11. Organisers' discretion The Organisers may amend or curtail the programme, or remove any participant from the event without refund, where safety, unlawful conduct, or conduct materially detrimental to the event requires it. 12. Images I consent to photographs and video taken at the event, in which I, my occupants or my vehicle appear, being used by the Organisers and their partners for coverage and promotion of the event without payment. 13. Acceptance I accept this indemnity electronically. My name, the date and time of acceptance and my IP address are recorded, and I agree that this acceptance has the same effect as my signature in terms of the Electronic Communications and Transactions Act 25 of 2002. This indemnity is governed by South African law.
